Sovereignty issues were recently raised in the New Zealand Parliament, mostly along racial-division lines, by Comrade Chloe, who asked Prime Minister Christopher Luxon “does the Prime Minister believe that Maori ceded sovereignty?”

Luxon replied that “our position is the Crown is sovereign” and was backed up by Winston Peters, who stated that “102 years ago in a major thesis, Sir Apirana Ngata set out the very circumstances of the Treaty, and he said that Maori ceded sovereignty”.

Of course, CSM have previously reported on Treaty of Waitangi issues and have raised questions about different versions of this document.

The issue of the He Whakaputanga Declaration of Independence which existed prior to the Treaty, as well as the fact that not all Maori signed the Treaty, is also worth considering.

And in any case, despite all these considerations, in 1986 under the David Lange government, a bloodless coup took place in Parliament, with the passing of the Constitution Act 1986, which declared that the previous New Zealand Constitution Act 1852 and other constitutional documents, would no longer have effect in New Zealand.

The corporation which currently masquerades as our government and which is known as HER MAJESTY THE QUEEN IN RIGHT OF NEW ZEALAND is also not the ‘Crown’ which the Treaty of Waitangi was signed in relation to.

In an interview on the same episode of Te Ao with Moana, Greens co-leader Chloe Swarbrick signalled her intention to make the Greens the lead party in Opposition. The Treaty of Waitangi is New Zealand’s founding document and takes its name from the place in the Bay of Islands where it was first signed, on February 6 1840. Saying ‘no’ Taraia Ngakuti Te Tumuhuia, a Ngāti Tamaterā leader in the Thames area, was one of several rangatira who declined to sign the Treaty. Others included Ngāi Te Rangi leader Tupaea of Tauranga, Te Wherowhero of Waikato-Tainui, and Mananui Te Heuheu of Ngāti Tūwharetoa.

Missionary Henry Williams and son Edward translated the English draft into Māori overnight on February 4. About 500 Māori debated the document for a day and a night before it was signed.

The Treaty was prepared in just a few days.

Labour Leader Chris Hipkins has become the first leader of a major political party to acknowledge the historical truth that Māori did not cede sovereignty, in an interview on Te Ao with Moana.

At the time of the signing of the Treaty, the Maori population was between 80 – 100,000 people compared to 2000 settlers. The idea that Māori intended for the Treaty to take from them their tino rangatiratanga is laughable and only something that people like Christopher Luxon, Winston Peters and David Seymour cling to because they think rolling out reality is too hard.

People should know there was an English and Māori version of the Treaty and that the Māori version of the Treaty gained 90% of the signatures.

They should also know that when there is a difference in the versions and disagreements that international law states the indigenous version is the one that is upheld.

Māori didn’t sign away sovereignty no matter how much the angry reactionary right want that to be true and since the signing of the Treaty, the Crown and Māori have worked to try and flesh out the promise of the Treaty.

They managed this with the Treaty principles which provided a guide on how the Crown was obligated to work with Māori to honour a Treaty with an indigenous people who didn’t sign away their sovereignty. These principles were designed in 1987 by the courts and have been accepted and acted on by every government since then. (CAME AFTER 1986 ASSUMPTION TO RULE)

For the most part, Māori and pragmatic Pākehā have found ways to work together for a better shared future.

The problems have arisen when angry reactionary right wingers who don’t know their history start agitating against the process. Pākehā and Māori have been learning to work together for almost 200 years. Māori don’t want separatism; they want history accepted and genuine attempts to work together in partnership with the Crown to deliver tangible and much-needed resources so that Māori are able to move forward and turn around some of the negative statistics we all know act as a barrier for Māori to truly thrive.

Yes, the Māori Party want a Māori parliament, separate legal and health systems, and that’s fine and their right to advocate that. However, I believe that most Māori are more focused on housing, jobs and the welfare of their families, the bread-and-butter issues will always be at the forefront.

This along with Māori language and culture being accepted as an integral part of this country’s identity is what I think most Maori want. We don’t want a revolution, we just want to be treated like a respected partner that the judges of 1987 said we were.

Minister for Treaty Negotiations Paul Goldsmith will meet formally with Ngāpuhi hapū for the first time today.

The Minister was invited to join a pre-planned meeting of Te Kotahitanga o ngā Hapū Ngāpuhi – a confederation of Ngāpuhi hapū who meet regularly – and will take place amidst a backdrop of the “sovereignty question”, said Ngāti Hine leader Pita Tipene.

Tipene – who is the chairperson of Te Kotahitanga – said it was established to oppose the Tūhoronuku Mandate, a board created and later rejected to represent the Northland iwi through the settlement process.

“Te Kotahitanga continues to have a goal to be a forum where the hapū of Ngāpuhi can come together and configure themselves for Treaty negotiations as they want to, not as anybody else may want to, including the government.  

“We’re very clear that hapū of Ngāpuhi have our mana motuhake, and therefore we will decide how to best move forward together and not have, certainly, the government impose itself upon the hapū.” (THEN CEASE PARTNERING WITH THE NWO) It will be the first time the minister has attended a Kotahitanga hui, Tipene said, and the minister’s office confirmed this was the first official meeting with wider Ngāpuhi representation.

“The minister was invited to come and speak and hui with the hapū of Ngāpuhi,” said Tipene, “he’s accepted and that’s why he’s coming here today. So we’re looking forward to the kōrerō we’re about to have.”Tipene is hopeful the minister will be open to processing the claim in a way that aligns with Te Kotahitanga, and points out Goldsmith has been in the role for nearly one year now.
“So he’s had a lot of time to think. He’s had a long time to ponder and talk with his coalition partners as well about the how the government may be seeing the landscape for the hapū of Ngāpuhi moving forward.”
But Tipene also pointed out that as minister for justice, Goldsmith was also overseeing other coalition policies such as the Marine and Coastal Area Act reform that is “prominent in the minds of the of the hapū of Ngāpuhi” and mentioned the Treaty Principles Bill as another key issue.
“What we’re very, very clear about as hapū is that the backdrop of all of this is that the hapū have never ceded sovereignty.”
“So while we may be talking about Treaty negotiations, in the backdrop, there is the sovereignty question,” Tipene added, referencing the statement by the prime minister recently that Māori ceded sovereignty.”So that particular backdrop will be made very stark to the Minister when he arrives today.”
Tipene said having the government openly recognize that Māori did not cede sovereignty was something “we certainly want to hear”. (Rather than bowing down to a mole hill bow down to a lofty mountain stand in sovereignty its called doing, living, being)
“Conversation has to start somewhere” said Tipene, “we just have to hear what the minister, this minister’s, position is today, and we’ll be all listening very, very carefully when he speaks.”
Tipene said the hapū wanted to move forward, but they did not want to be reactionary (standing in truth, speaking it, is not being reactionary so do it even if your knees shake) and , nor did they want the government to “corral them into configuring themselves as the government sees fit”, or reacting to a “government agenda”. While speaking, Tipene differentiated between ‘Ngāpuhi’ and the ‘hapū of Ngāpuhi’.
“Because the moment you call ourselves Ngāpuhi, there’s that imperceptible view that Ngāpuhi is all together on this.
“Yes, we are, but the hapū will have the last say, and certainly we don’t want to plunge ourselves into another 10 years of civil war.”
Negotiations with Ngāpuhi for a settlement began in 2009, but when the Crown recognised the Tūhoronuku Mandate in 2014, not all hapū felt they were adequately represented by that board. The Waitangi Tribunal also found the Mandate undermined the rangatiratanga of hapū and was therefore flawed.
Treaty Negotiations Minister Chris Finlayson withdrew from the process in 2017, before Andrew Little later picked up the negotiations.
When Goldsmith picked up the portfolio, he indicated he was committed to settling Ngāpuhi’s Treaty claim, but didn’t want to “relitigate” arguments about legal sovereignty. (The Restoration is legal sovereignty and its staying regardless of Government and any Maori attempting to sign away Maori sovereignty)

I received this beautiful email on Oct 2nd decided to share it today Dear Debra,

When I was growing up, we didn’t talk about the Te Tiriti o Waitangi in my household. It never came up, and I didn’t think to ask about it.

But about ten years ago, I found myself in a sunny community room at the local library, listening to renowned thinker, the late Moana Jackson share his thoughts with a curious crowd. As one of the only young people in the room, his talk started to fill in the blanks of such an important part of our history.

Moana told us about how he and a committed group of people travelled the country to speak with Māori about the future they dreamed of. What started as 30 community meetings, turned into 252! From 2012 to 2015, they met with Māori from all walks of life asking questions about how we can move forward together as a country.

These discussions were captured in a report often called Matike Mai, and the hope was to continue to spark a conversation among communities about what a constitution for Aotearoa could look like based on kawa, tikanga, and our country’s founding documents He Whakaputanga (Declaration of Independence) and Te Tiriti o Waitangi (te reo Māori language texts of The Treaty of Waitangi).1 It changed the way that I thought about our country forever.

Here are five things I learned from Matike Mai:

1. Te Tiriti o Waitangi created a home for everyone

What often gets missed when we talk about Te Tiriti today is it wasn’t just about Māori at all. While hapū and iwi have long histories of governing ourselves, it was the British struggling to ensure their people visiting our shores behaved themselves – and when they didn’t, it put our relationships, including trade, in jeopardy. The 500+ rangatira (leaders) who signed Te Tiriti gave the British the ability to establish governance over their people here, so that everyone could live in peace and continue to seek prosperity, together.

In the Matike Mai hui, many Māori believed that Te Tiriti was inclusive and invited newcomers to become a Tangata Tiriti (person of the Treaty) and call this country home. Just as Māori had a sense of belonging here, they made it possible for others to have the same security and connection to this beautiful country. The intention was never that Māori would stop governing themselves, simply because British settlers were allowed to set up their own governance. There was a place here for all of us, and we could each look after our people as we saw fit.

2. Te Tiriti o Waitangi is about a relationship

It’s easy to get stuck in talk about treaty principles, but at its heart – Te Tiriti is about an enduring relationship between two different, independent peoples. Moana would often talk about how hapū and iwi had a history of making treaties and strategic alliances between each other. When you live on an island – you have to learn how to get along most of the time! Good relationships are based on respect, dignity, communication and care for one another. But unfortunately, the Crown (or NZ Government) hasn’t always respected the relationship with hapū and iwi, putting their own hopes and dreams first and making things harder for Māori to survive and thrive.

3. Māori are still passionate and committed to Te Tiriti

Despite 184 years of an unequal and discriminatory relationship, Māori still believe in the future that Te Tiriti can offer us. Many Māori accept that those of our tūpuna (ancestors) who signed the agreement did so in good faith to create an honourable, equal and equitable relationship with the Crown. Even when we feel at our most hurt, frustrated or cynical, we know that the agreement was sacred, significant and bigger than all of us. It gave many of us a living blueprint for how different people from across the world could prosper together, despite all odds.

4. It’s all about values

The hope that emerged from Matike Mai is that our country’s governing structure can make decisions based on values that we all think are important – instead of the whims of the political moment. Some of the values that came through from over 70 meetings with young people included protecting the health and wellbeing of our natural environment, ‘kotahi aroha’ – the right of all peoples to peace and mutual respect, and the rights of all to access education, health and well-being. Instead of electing political parties who change things up every three years – imagine if we had a government that was accountable to the values that really matter to us, so we can all have good lives. Te Tiriti offers a guide to make laws and systems based on values we share, including respect and dignity for all people in Aotearoa.

5. We can find a way forward together

What inspired me the most about Matike Mai is that it showed how Te Tiriti gives us practical solutions for where we go next as a country. Matike Mai suggested different examples for decision making which ensure Māori get to have a say over the things that are important to them, whilst ensuring we can all continue to look after each other and work together. By changing our structures to better reflect Te Tiriti, we can repair past harms, and move forward together on an equal footing. Some organisations and churches have already modelled relationships where decision-making is shared, so that our differences are embraced and everyone has an equal say. Structural changes like Māori wards and the Māori Health Authority were ways to make sure Māori got to decide the right way to meet our own needs, while creating a positive, respectful relationship with councils and the health system.

So where to from here?

Together we can chart a path forward where our differences are celebrated, embraced and normalised.

Every opportunity that we get to learn more about and honestly reflect on our history, we enrich the social fabric of our country for future generations. The more we know today, the better decisions we can make for tomorrow.
